If you are inside Canada and applying for Permanent Resident status OR, if you are applying outside Canada for Permanent Resident Visa, and you do not fit the qualification and/or you are inadmissible (except inadmissibilities due to security, human and international right violations, sanctions, or organized criminality), you might be able to use the Humanitarian and Compassionate Consideration (H&C) as long as there is enough compelling reasons, taking into consideration the best interest of a child directly affected by the decision.


     Between January and August 2023, less than 51% of the submitted application for H&C were successful. So, you need to make sure that you are putting your best foot forward when you submit this kind of application. It is a very daunting process because you have to persuade the Officer to grant you that exemptions. You should be able to answer the question " Amongst the thousands and thousands of applicants for Permanent Residency, why should you be exempted? What sets you apart?"


     So you need someone who is knowledgeable about the Immigration Law and someone who can argue on your behalf and that is where an Immigration Law Professional like a Lawyer or Consultant comes into play.


     Most of the people using H&C are people who are without status in Canada, people who want to sponsor their de facto family member, those who are inadmissible due to medical reasons, criminality or due to inadmissible family member(s).
