If you are inside Canada and applying for Permanent Resident status OR, if you are applying outside Canada for Permanent Resident Visa, and you do not fit the qualification and/or you are inadmissible (except inadmissibilities due to security, human and international right violations, sanctions, or organized criminality), you might be able to use the Humanitarian and Compassionate Consideration (H&C) as long as there is enough compelling reasons, taking into consideration the best interest of a child directly affected by the decision.
Between January and August 2023, less than 51% of the submitted application for H&C were successful. So, you need to make sure that you are putting your best foot forward when you submit this kind of application. It is a very daunting process because you have to persuade the Officer to grant you that exemptions.
